Terms of Use

These terms govern your use of the Miserably Unemployed Job Board and Tailoring Service (the "Service"), operated by Miserably Employed, LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these terms.

1. Who can use the Service

You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information when you create an account and to keep it up to date.

2. What the Service does

We aggregate publicly listed job postings from third-party applicant tracking systems and job boards into a searchable inbox. We also offer AI-assisted resume tailoring against a specific posting. Tailoring is paid for with credits, which you can purchase. Credits are not refundable once used.

3. Your content

You retain ownership of any resume, persona, or other material you upload (your "Content"). You grant us a non-exclusive, worldwide license to process, store, and transmit your Content for the sole purpose of operating the Service for you, including sending it to the AI providers that perform the tailoring. We do not use your Content to train third-party models.

4. AI output disclaimer

Tailored resumes, cover letters, and other AI-generated output are suggestions. They may contain errors, hallucinations, or content that does not accurately reflect your background. You are responsible for reviewing everything before you submit it to an employer. We make no guarantee that using the Service will result in an interview, an offer, or any other outcome. Generated output is retained for ninety days and then automatically deleted; you can regenerate it at any time from a saved job and persona.

5. Job listings

Job postings are aggregated from public sources. We do not endorse, verify, or guarantee the accuracy, availability, or legitimacy of any posting. Apply at your own discretion. If you believe a listing is fraudulent or scraped inappropriately, please email us so we can investigate.

6. Acceptable use

You agree not to:

  • Scrape, mirror, or programmatically extract listings or other data from the Service for redistribution.
  • Use automated tools, bots, or scripts to interact with the Service.
  • Submit content that infringes any third party's rights or is unlawful.
  • Attempt to bypass authentication, access controls, or rate limits.
  • Resell, sublicense, or otherwise commercialize access to the Service.

7. Payment and credits

Credits are purchased via Stripe. Pricing is shown at checkout. Credits are consumed when you generate a tailored output. Credits are not refundable once used, and they do not expire while your account is in good standing. We may change pricing at any time, but a price change will not retroactively affect credits you have already purchased.

8. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these terms, attempt to abuse the Service, or for any other reason at our reasonable discretion. We will not refund unused credits if your account is terminated for cause.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, Miserably Employed, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service. Our total aggregate liability for any claim arising under these terms will not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Delaware.

12. Changes to these terms

We may update these terms occasionally. If we make a material change we will update the effective date at the top of this page and, where appropriate, notify you in-product or by email. Continued use of the Service after a change means you accept the revised terms.
